What's different when a spouse lives abroad

The underlying laws — the Hindu Marriage Act, Special Marriage Act, and related maintenance and custody provisions — still apply. What changes is practical: document attestation, powers of attorney, video appearance where courts permit it, and coordinating timelines across time zones and, at times, jurisdictions.

We cannot guarantee recognition of an Indian decree by a foreign jurisdiction, or vice versa — that depends on the receiving country's own law. Common questions

Can my spouse and I file for mutual consent divorce if one of us lives abroad?

It is often possible, with appropriate arrangements for appearance — sometimes including power of attorney or, where a court permits, video appearance. We confirm what your specific court will accept.

Will an Indian marriage certificate be accepted abroad?

Generally yes for many purposes, though some countries require additional attestation (such as apostille) depending on their own requirements. We help prepare the Indian documentation correctly; recognition abroad may still need local advice.

Can I file a maintenance or custody claim in India if my spouse lives overseas?
